The Adams Report by J.C. Adams – June 27 – July 3, 2005

The Free Speech Coalition (FSC) returned fire in the latest salvo between the adult industry and the ferociously anti-porn Bush White House. In a negotiation that went right down to the wire, the FSC struck a deal with the U.S. Department of Justice to put a hold, per AVN.com, “on inspections and prosecutions of FSC members under U.S.C. 2257 regulations until 30 days after the organization’s preliminary injunction hearing scheduled for August 8.” As a result of this deal, which applies only to members of the Free Speech Coalition, dozens of adult webmasters and studios “found religion” (per AVN), swamping the FSC with last-second applications for membership. And the beat goes on.

“The battle is joined,” intones a headline on AVN.com, and it ain’t hyperbole. The article continues, “With the filing on Thursday [May 17th] of the Free Speech Coalition’s massive lawsuit challenging the new regulations drawn from…the recordkeeping and labeling law, 18 U.S.C. 2257, the adult industry prepares for a legal battle that may determine whether it can survive against the onslaughts of the Bush administration’s anti-adult agenda. Certainly it will determine the industry’s profitability for decades to come.” Ah, “profitability.” Yes, now you’ve got everyone’s attention.

Venerable kink studio Bound & Gagged is closing up shop. Company president Bob Wingate announced the closure this week on their website and attributes the decision to pending revisions in the Federal Labeling & Recordkeeping Law, known in shorthand around the biz as “2257 regulations” (U.S.C. Title 18, Section 2257). They go into effect June 23rd, and you can thank our fanatically conservative political leaders for it. The new regulations, per Mr. Wingate, “will impose record-keeping and inspection requirements for adult photographs that will be virtually impossible for us to comply with… Thanks very much for all the pleasure you’ve given me over the years. May happier times come soon.”

Last week I wrote about author (and former porn star) Rich Merritt, whose memoir, “Secrets of a Gay Marine Porn Star” (Kensington Books) will be published this month. Now comes word Mr. Merritt was fired from his Atlanta law firm due to the revelations in his book. “They told me some of the contents would diminish my effectiveness as an attorney with clients,” Mr. Merritt said in an interview. “They made sure it was not a sexual orientation issue.” I guess that makes it a porn issue, then?
